PROJECT DESCRIPTION

Legal, economic and regulatory issues of Big Data and cloud computing

Proposal Outline:

This is a project proposal for a Marie-Curie Innovative Training Network (ITN) on legal, economic and regulatory issues of the Big Data environment.

ABSTRACT

One of the most challenging issues in today’s policy making is the ever increasing significance of data in business, economy, governance, scientific research and everyday life. Lack of legal certainty as to what is permissible and not permissible with respect to data, and as to what can be owned and what should remain in the public domain, may have unpredictable effects not only on citizens’ privacy and self-determination, but also on future research innovation.

This Innovative Training Network (ITN) aims at providing the necessary theoretical and practical skills to better understand (a) the many ways in which big data challenges the current legal framework, (b) the way in which legal principles can be translated into a fair and proportionate regulatory framework, and (c) how new technologies can help giving effect to regulation.

The PhD research projects carried out under this ITN will address this threefold issue from a law and technology perspective, covering areas such as:

  • e-privacy and data protection;
  • cyber security;
  • intellectual property rights;
  • liability of ISPs and other intermediaries;
  • contract and consumer law;
  • competition law;
  • public sector information;
  • open data;
  • law-and-economics analysis of data markets.

The PhD students engaged in this ITN are expected to have a solid legal or economic background and, most importantly, to be able to engage in a fruitful dialogue with the industry. Their research is expected to provide new insights and original thinking on how law should respond to the challenge of Big Data in today’s economy.
